These Terms & Conditions apply to the Memory Bank app and related services created by William McKee. By downloading, accessing, or using Memory Bank, you agree to these terms. If you do not agree, do not use the app.
Memory Bank is a journaling app for creating journals, entries, moments, places, and media collections. Some features require an account, internet access, device permissions, or third-party services such as maps, authentication, storage, and speech recognition.
You are responsible for the journals, entries, moments, photos, videos, captions, locations, and other content you create or upload. You should only upload content that you have the right to use. You retain ownership of your content, but you grant Memory Bank the right to process, store, display, sync, and transmit it as needed to operate the service.
Some features request optional device permissions, including location, photo library, camera, microphone, and speech recognition. Smart Suggestions may use location or photo-library metadata only if you enable those features. You can change Smart Suggestions settings in the app and can revoke device permissions in your operating system settings.
You are responsible for keeping your device, account, and sign-in methods secure. Do not use Memory Bank in a way that interferes with the service, attempts to access another person's account, or violates applicable law.
Memory Bank may offer free, beta, paid, or freemium features. Any charges or storage limits will be clearly presented before purchase or use. Storage limits and feature availability may change over time.
Memory Bank relies on third-party services for functionality such as app distribution, maps, place search, authentication, storage, email, and speech recognition. These services may have their own terms and privacy policies. Memory Bank is not responsible for third-party services outside our control.
We try to keep Memory Bank available and working well, but the service may be interrupted, unavailable, delayed, inaccurate, or changed. Some features require internet access or platform services that may not always be available. You are responsible for any data, roaming, or carrier charges that may apply.
You may not copy, modify, reverse engineer, or create derivative works from the app except as permitted by law. You may not use Memory Bank to upload unlawful content, violate others' rights, abuse the service, or attempt to bypass security, usage limits, or access controls.
You may delete your account in the app. Account deletion is intended to permanently delete your account data and uploaded media from Memory Bank's systems. Some records may be retained only if required by law, necessary for security, or necessary to resolve disputes.
Memory Bank is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
To the fullest extent permitted by law, William McKee and Memory Bank will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business opportunities arising from your use of the app.
We may update the app, change features, set limits, or discontinue parts of the service. We may also update these terms from time to time. When we do, we will update the "Last updated" date above. Your continued use of Memory Bank after changes are posted means you accept the updated terms.
